I refer to the report on page 11 of the ET on Thursday headed Smoker Hits Back After Fine Of £155.
I do not wish to comment on the rights or wrongs of this case but I am wondering if this is another example of the East Northants Council taking a high handed attitude?

I received a letter from the council dated July 8 and I will quote the relev
ant paragraph, as follows:

"I have recently received a complaint that you may be removing your dogs faeces from the ground with a plastic bag and leaving it bagged up on residents' driveways and public footpath." They then went on to tell me what the penalties are for this offence, etc, etc.

They did not give me any further information such as dates of the alleged offence or the name of the complainant.

I replied to them immediately in writing telling them that I wished to protest in the strongest terms as I do not own a dog, have never owned a dog and do not particularly like dogs. Neither do I do dog walking for anyone else.

At best I believe this is a case of mistaken identity but the attitude of the council seems to be that 'You're guilty but if you're not it's up to you to prove otherwise.'

Graham, you're quite right about the "guilty until proven innocent" attitude of local authorities. They've been given ludicrous powers, and they're abusing them - overturning the concept of English Law that you're innocent until proven guilty.
Kettering Council issued THREE fixed penalty notices against me last year accusing me of throwing a cigarette from my vehicle. I refused to pay as I did NOT commit any of the offences. (I am ardently anti-litter, and had, until that point, strongly supported the littering penalties. However, I hadn't realised that their case could simply be based on lies by their warden without any supporting evidence - the fact that their video equipment wasn't used, nor was any physical evidence presented was ignored by the court in favour of the warden's scribbled lies).
I was subsequently taken to court where, to my amazement, I was found guilty - costing me £606.00 for something I had NOT done - not to mention the mental scarring!
Whilst our police may have to stick to rules of evidence, it appears our councils can victimise and abuse citizens with impunity. No justice, no democracy, NO ACCOUNTABILITY!
